So, on one side I am glad that you are going to install security cameras, but there are several questions:

1) Why did you wait so long to install them? This is something that made sense to do since day 1, no?>
2) What is the intent? You catch them breaking the lock, then what? Arrest them for breaking and entering? Use that in court? I am sure they agree that they go to the site periodically but they are going to claim that is their property...so what does videotaping get you? These guys are not going to pay you, so is this just evidence gathering for litigation?

It appears we've reached an informal understand with Dominion regarding certain types of access to the property. We still intend to take legal action against them as they have no right to maintain their well on the property. We're also doing surveillance and the equipment they bring appears to be a lot more than something that would just monitor their site. We can't say for certain that they're removing gas, but when a large tanker comes with hoses attached, we tend to believe that something is being removed.

We plan on moving forward in the next couple months against them because they aren't being forthright with us.

Good to read that DOM is beginning to "thaw" a bit. I guess they are realizing that BCND is not a flash in the pan organization that can be bullied or waited out.

So, what are you going to do to validate what they are doing on-site? Can't someone be there when the DOM truck(s) show up? Do they arrive on a standard schedule?

The Company has retained legal counsel to file suit against Dominion Resources for their continued use of our land after being served with an eviction notice under the terms of the lease. We expect suit to be filed over the next 90 days, but cannot guarantee the timeline as we are focusing resources on cleaning up and demolition of the property.

You say that the lawsuit will occur within the next 90 days but can't be guaranteed as resources are focused on the demo...

1) I mean no offense, but aren't you able to multi-task?? If you have retained legal counsel for the lawsuit, what do they have to do with the demo? I would assume that the lawyers aren't also the plumbers or demo guys or drivers, etc....so what do the two have to do with each other.
2) I would expect even if there was no evidence when Rick took over, that there is AMPLE evidence that DOM has been on-site without permission, etc. What is taking so long to file? You have pictures of locks that they have broken, evidence that they have been on-site, etc.....let's take them to court!
3) I guess I am saying that, does it really need to be done one thing at a time???

Lawsuits aren't written by lawyers, they're condensed by lawyers.

As to evidence of wrongful entry to the property, we have recently been monitoring their activities and conducting surveillance as to what they're doing on our land. Our primary claim will be for possession of our land. The damages will be secondary.
